1. Acceptance of Terms

By accessing, registering for, or using the website webseum.co (hereinafter referred to as the "Platform" or "Webseum"), you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the Platform. The Platform is operated by Marcus Vonthien (hereinafter "Operator", "we", "us").

2. Description of Service and User Accounts

Webseum is an interactive digital grid (Canvas) where users can claim coordinates and submit digital projects, websites, or products ("Exhibits") consisting of a title, a URL, and an optional image. Creating a user account to submit an Exhibit is entirely voluntary. If you choose not to create an account, you will receive a unique link containing an ID, which you can use to edit or manage your Exhibit at a later time. If you do choose to register, you are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate and complete information during submission or registration.

3. Submission, Manual Approval, and Rejection

All Exhibits and subsequent changes to existing Exhibits submitted by users are subject to manual review and approval by the Operator before they are published on the Platform. No Right to Publication: Submitting an Exhibit does not guarantee its publication. The Operator reserves the absolute right, in their sole discretion and without providing reasons, to reject, refuse to publish, modify, or subsequently remove any Exhibit or user account at any time. The manual approval process is conducted solely for the purpose of maintaining the thematic integrity of the Webseum and preventing obvious abuse (e.g., spam). The approval of an Exhibit does not imply that the Operator endorses the content, assumes ownership of the content, or verifies its legal compliance. The sole responsibility for the legal compliance of the Exhibit remains entirely with the user.

4. User Content and Warranties

When you submit an Exhibit, you retain all your ownership rights to your content. However, you grant the Operator a worldwide, non-exclusive, royalty-free license to use, reproduce, display, and distribute your Exhibit (title, URL, image) on the Platform. By submitting an Exhibit, you expressly represent and warrant that:

You agree to defend, indemnify, and hold harmless the Operator from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from:

6. Platform Availability and Disclaimer

The Platform is provided on an "AS IS" and "AS AVAILABLE" basis. The Operator does not warrant that the Platform will be uninterrupted, error-free, completely secure, or that any defects will be corrected. We reserve the right to modify, suspend, or discontinue the Platform (or any part thereof, including the digital grid or specific Exhibits) at any time, with or without notice. The Operator shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Platform or the loss of any submitted data.

7. Intellectual Property of the Operator

All aspects of the Platform (excluding the user-submitted Exhibits), including the overall design, grid mechanics, code, graphics, and the "Webseum" name, are the intellectual property of the Operator and are protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works from the Platform's core elements without explicit written permission.

8. Changes to the Terms of Use and Privacy Policy

We reserve the right to modify these Terms of Use and the Privacy Policy at any time. We do not send emails or separate notifications regarding changes to these documents. You are obligated to regularly review the Terms of Use and Privacy Policy for updates. Continued use of the Platform after any modifications constitutes your automatic and binding consent to such changes.

9. Governing Law and Jurisdiction

These Terms of Use shall be governed by and construed in accordance with the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer, mandatory consumer protection provisions of the country in which you have your habitual residence remain unaffected.
